Terms and Conditions

Effective date: 20 October 2026 · Last updated: 20 October 2026

Important product description. ClaudeMax is a separate third-party API access service. It is not the official Claude web or mobile subscription service. API access does not automatically include official account features, native apps, connectors, MCP integrations, or other features unless expressly listed and technically supported.

These Terms and Conditions (“Terms”) govern access to the ClaudeMax website, account dashboard, subscription plans, API access, compatibility tools, customer support, and related services (collectively, the “Service”). The contracting provider is ClaudeMax (brand name; legal entity or individual contracting seller not specified), located at Website: https://claudemax.tech. Physical/postal business address not provided. (“ClaudeMax,” “we,” “us,” or “our”).

By placing an order or using the Service, you (“Customer” or “you”) agree to these Terms and the policies linked at checkout. These Terms do not remove any right or remedy that cannot lawfully be excluded.

1. Provider identity and contact details

Before purchase, the website will identify the legal name of the provider, its business address, customer-support channel, and any other seller information required by applicable law. Customers may contact support@claudemax.tech for account and service questions. Do not publish this document until the bracketed details are completed and verified.

2. What the Service is

ClaudeMax provides access to selected AI models through compatible API requests, software clients, coding tools, and integrations. We may rely on third-party API providers, hosting systems, network providers, and credential-management infrastructure to deliver the Service.

ClaudeMax is a separate service and is not an official subscription to another provider’s first-party app. Plan names such as “Claude Pro,” “Claude Max 5X,” and “Claude Max 20X” are ClaudeMax plan labels only; they do not establish that the Customer receives an official subscription account or the same entitlements as a first-party plan. Third-party trademarks belong to their respective owners.

3. Plans, prices, and plan descriptions

The price, billing period, supported access method, model availability, usage basis, compatibility, and any stated limits are the details shown on the plan page and checkout immediately before purchase. Those details form part of the order. If a summary elsewhere on the website conflicts with the checkout details, the more specific information shown before payment will govern, subject to applicable law.

Usage-basis requirement: Before accepting payment, ClaudeMax will plainly identify whether the above figures are individual customer allowances, shared-pool limits, provider-side ceilings, estimates, or another defined usage measure. A figure that is not reserved for one Customer must not be described as a guaranteed individual allowance. The operator must verify all figures against the actual upstream service before publication.

4. Models and model identifiers

Model access is limited to models actually exposed by the upstream provider and enabled for the Customer’s plan. A displayed model name is not a guarantee of availability in every client or at every moment. Model names, versions, identifiers, context limits, and capabilities may change as upstream providers update their services.

Before publishing a model catalogue, we will verify each model identifier against the live service and remove or qualify models that are unavailable. If a material advertised model is unavailable, the Customer may contact support for troubleshooting and an appropriate remedy under these Terms and applicable law.

5. Third-party status and feature compatibility

API access is technically different from a first-party consumer subscription. It does not inherently provide native web chat history, native mobile app access, official account-level usage displays, first-party connectors, MCP features, or any other feature that is not supplied by the API and the Customer’s compatible software.

Any supported application or integration must be named accurately on the relevant plan page. Some applications may require separate software, a license, setup, or configuration. Customers should confirm compatibility before purchase if a specific app or workflow is essential.

6. API credential model and shared capacity

The Service may use credentials or infrastructure managed by ClaudeMax to route API requests. Where access relies on a shared upstream resource or capacity pool, that arrangement must be disclosed on the product page before the Customer pays. A shared resource can result in aggregate demand, rate limits, and concurrent requests affecting an individual Customer’s throughput. ClaudeMax does not promise a reserved individual capacity unless the order expressly says so.

We may rotate or replace credentials when necessary for security, maintenance, upstream changes, or service recovery. Replacement can restore a credential-level problem but cannot guarantee that the upstream provider, model, or whole Service remains available. Customers must not publish credentials or use them outside the permitted access method.

7. Usage calculation and technical limits

Token counts depend on the upstream provider and may include input, output, system instructions, tool interactions, cached content, or other processing categories. Different models and providers may count tokens differently. Actual response time and throughput can depend on prompt length, output length, model selection, rate limits, request complexity, network conditions, and concurrent demand.

Any usage figure applies only to the precise time window and counting method stated in the plan description. A “5-hour window” or “weekly” limit must be defined in the product documentation so that a Customer can understand when it resets and how usage is measured. Unused capacity does not roll over unless the plan expressly says otherwise.

8. Account registration and security

You must provide accurate information and keep account details current. You are responsible for protecting your login credentials and for activity conducted through your account, except where applicable law provides otherwise. Notify us promptly of suspected unauthorized access. We may ask for reasonable verification to protect an account, investigate abuse, or comply with law.

9. Acceptable use

You must not use the Service to break the law, infringe third-party rights, distribute malware, attack systems, bypass security restrictions, resell credentials without authorization, or interfere with service availability. You must comply with applicable law and any third-party terms that govern your use of a connected service, to the extent disclosed and applicable.

10. Service availability and maintenance

We aim to provide a reliable Service but do not promise uninterrupted access unless a separate written service-level agreement states otherwise. Interruptions may result from maintenance, software defects, network failures, upstream outages, model changes, security incidents, or other technical conditions. Where reasonably practicable, we will communicate material planned maintenance or significant incidents.

An outage or upstream restriction does not automatically eliminate any remedy that may be available under the plan description, the Refund and Cancellation Policy, or applicable law. If the Service is materially different from what was promised at checkout, contact support.

11. Credential failure, replacement, and restoration

If an access credential becomes invalid, we may provide troubleshooting, rotation, or replacement where reasonably available. A replacement is a recovery measure, not a promise of continuous service. If access remains materially unavailable after reasonable troubleshooting, the Customer may submit a support request so the issue and applicable remedies can be assessed.

12. Payment, billing, and taxes

Prices and mandatory charges will be displayed before payment as required by law. Activation may follow confirmation from the payment provider. We do not knowingly charge more than the amount authorized for the order, except for a lawful and properly disclosed adjustment. Any automatic renewal must be clearly disclosed before purchase; where a plan requires manual renewal, no automatic renewal charge will be made.

13. Suspension and termination

We may restrict access where reasonably necessary to protect security, investigate suspected fraud or abuse, address non-payment, comply with law, or respond to a material breach. Where practicable and legally permissible, we will give notice of a material restriction and explain the steps to resolve it. If an upstream provider terminates or materially restricts a dependency, we will communicate the impact and consider an appropriate remedy under the purchased plan, linked policies, and applicable law.

14. Intellectual property

The ClaudeMax website, original branding, documentation, and proprietary software are owned by ClaudeMax or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service during the purchased period. Third-party models, trademarks, software, and documentation remain the property of their respective owners.

15. AI-generated outputs

AI outputs may be inaccurate, incomplete, outdated, or unsuitable for a particular purpose. You are responsible for reviewing outputs before relying on them, especially for legal, medical, financial, safety-critical, or other consequential decisions. Do not assume generated content is original, confidential, or free of third-party rights without appropriate review.

16. Privacy

Information handling is described in the Privacy Policy. Requests submitted to AI models may be processed by third-party providers to generate responses. Customers should avoid sending sensitive or confidential information unless the data-handling arrangements are appropriate for their purpose.

17. Customer support and complaints

For service issues, contact support@claudemax.tech and include your order reference, plan, approximate time of issue, affected model or application, and relevant error message. Do not email passwords or complete API credentials. We will acknowledge and review complaints within the period required by applicable law and the published support process.

Grievance contact: Chatbot (automated support); role provided: support staff. A responsible human grievance contact should be identified where required by law. · Not provided. The website domain is not a postal address. · support@claudemax.tech · Support hours: 10:00 AM–10:00 PM. Response timeline not specified.. Complete these details before publication where required.

18. Disclaimers

Except for commitments expressly made in the applicable plan description and except where law provides otherwise, we do not guarantee that every model or third-party application will remain available, that all outputs will be accurate, or that the Service will be free from interruptions. Nothing in these Terms excludes a statutory right or liability that cannot lawfully be excluded.

19. Limitation of liability

To the extent permitted by applicable law, neither party will be liable for indirect losses that were not reasonably foreseeable. This clause does not exclude liability for fraud, wilful misconduct, or any liability that cannot lawfully be limited. Any limitation will be interpreted consistently with mandatory consumer protections and the actual circumstances of the transaction.

20. Changes to the Service or these Terms

We may make technical changes to maintain security, compatibility, and functionality. Material changes affecting a paid plan will be communicated where reasonably practicable and as required by law. We may update these Terms by publishing a dated version and providing notice where required. Changes do not retrospectively remove accrued rights or override mandatory legal protections.

21. Governing law and disputes

These Terms are subject to applicable Indian law and any other mandatory law that applies to the transaction. Customers may approach a competent court, consumer commission, regulator, or other forum where legally entitled to do so. Nothing in these Terms prevents a Customer from exercising a non-waivable statutory right.

22. General

If a provision is held unenforceable, the remaining provisions continue to apply to the extent lawful. These Terms, the order details, and the linked policies form the agreement concerning the Service, subject to mandatory law. A failure to enforce a provision on one occasion does not constitute a permanent waiver.
